there are several factors to consider. such as, what was the child doing at the time, how old the child is, and several other questions i would have for you... How old is the child and how did the leg break? There is a need for supervision and then there is the issue of safety of equiptment. Chances are that the school is at least partially responsible.

There are guidelines for schools regarding how many teachers/aides need to be supervising children. The school may be responsible. Also, depending on how and where he fell, a claim may lie against the manufacturer/installer of playground equipment he may have been using. More information is needed regarding this incident, but a school can be held liable for improper and inadequate supervision. It is important to note that if you are dealing with a public school, there are very strict time limits for filing a Notice of Claim to preserve your rights to file a lawsuit. More information is needed in terms of how the accident happened. Please keep in mind that if it was a public school, a Notice of Claim must be properly served within 90 days of the accident.
