can I go to court to get him or will I lose? I am so upset I keep looking at a cat to adopt but I gothim he was 11 months and he is now 5. she wont return any texts or emails.

Did you sign any paperwork with the foster? If yes, those documents most likely contain the answer. If it was a simple "hand shake" agreement, the Small Claims court can order the foster to return the cat based on a claim of specific performance--that is--if you prove to the Judge that both sides understood that you had no intentions of permanently relinquishing the cat.
Hope this helps.
