Legal Question in Civil Litigation in New York

Limits to Small Claims Court

Hi, I know that the limits for small claims in NYC has changed to $5000.00. My claim is for unpaid invoices in the amount of $ 4,800. With the interest it would bring the claim over $5,000.00 is this allowed?

Re: Limits to Small Claims Court

You are welcome to bring suit for any amount up to the jurisdictional limit ($5,000). That means that even if the court awarded you more, the amount would not be legally collectable.

However, you may charge interest on the judgment from the time the judgment is entered by the court. So if the other party does not pay, they will have to pay that later interest.
