Lying about mortgage rates

A mortgage rep. at emigrant savings bank promised me a second morgage at first mortgage rates. After the application fee was paid and i checked with her for six days straight she confirmed the rate had not changed.I paid for and had the appraisel done.that was approved when i went to lock in the rate i was told she made a mistake and read the chart wrong.she is stating she read it wrong six time and thuoght the rate for first and seconds were the same. i want the rate i was promised.If i don't recieve this i want to file a complaint and bring charges agianst the rep.

Sounds like you'll have a swearing match with your word against theirs.

I believe NYS Banking Dept. has a complaint procedure.
