Legal Question in Civil Litigation in New York
My mortgage company took a double payment from me which cause me to overdraft my account. I spent 3 weeks on the phone with them (even though they admitted fault) and finally got that and the resulting overdraft fees returned. But by then I had maxed out all of my credit cards and that refund had to go to that months mortgage payment. It has been 3 months and we still have not caught up on our bills (we have 3 children). Then last month I tried to refinance to get away from them and find out that they had incorrectly reported me to the credit bureaus as having a dispute with them. I have been told that this particular statement is meant to deter other companies from doing business with the consumer because they are a problem customer. Finally after several calls they said they would remove it three weeks later. I am now drowning in debt, companies calling me and sending me delinquent notices, and my credit is bad from the last instance and can't reapply to refinance because I won't qualify. Can I sue them for all of this hardship they caused in small claims court? (I'm in NY)
