Legal Question in Civil Litigation in New York

NY CLS General Obligations Law 11 - 105

My daughter was present when a girl shop lifted. She away from home and with friends. One of the girls shoplifted at Claire's. We were never let know of this situation, except by our daughter that day. Another parent took care of everything, as we were three hours away. Now Claire's is demanding that we pay them or be sued. This feels extortion. ''Pay us now or pay more later.'' Her name is spelled wrong on the paperwork.

Do we have to pay them?

The demand is rarely followed in court. How old was your daughter at the time of the theft, was she charged? Did she plead guilty? YOu are not responsible for your daughters debt under the GOL depending on the amount, you may want to see a lawyer of your own to protect yourself and your assests.
