Legal Question in Civil Litigation in New York

odometer rollback`

I purchaes a used car from a dealer offering creative financing, and incentives. The next day I ran a carfax check, and found that before the dealer aquired the car, there was a 24000 mile rollback indicated. The salesman told me not to worry about it, they would check it out. Now I am not sure exactly how many miles are on the car, and I feel that the dealer cannot tell me either. Should I return the car, or request a price break, as I also paid a lot more than the Blur Book value? Isn't this considered fraud?

I received your post on 9-18-2000.

It may be....you should have been provided with an odometer disclosure statement when you purchased the car. This statement will tell you whether it is the actual miles, or whether the odometer has been rolled back.

In the event of any problems, contact the dealer, and the NYS Attorney General.
