Someone Owes Me Money

I lent a friend $5,000 to help him pay for the cost of his wedding. He has avoided me and doesn't return my calls. This has been going on for more than 18 months. I have no written receipt. My only proof is that my wife physically handed the money to both him and his wife.

Could I bring them to court and have the judge place them under oath to reveal the truth and the judgement.

What options do I have?

I received your post on 6-22-2001.

Taken them to small claims court where the most you can sue for is $3000.00. If you takn them to a higher court, you may have to wait alot longer to get into the system, but you can sue Pro se in the Civil Courts in NYC or in District Court or Village or Town Court up to $25,000.00

There are other ways of showing circumstantially

that the money came from you, namely, your

withdrawals and cashed checks showing how

the money was accumulated and their lack

of similar proof. This can still be tried
