Parking Lot Damage
My car was damaged by a parking lot in NYC. They are offering to repair the vehicle at their facility only. I obtained 3 estimates on the repair which they are refusing to pay since they think it is excessive.

1. Can they force me to repair the vehicle at their facility?
2. If not how would a judge determine the fair cost of repairing the vehicle?
3. Are they obligated to pay for a rental vehicle while the vehicle is being repaired.

A. No.

A. If damages are under $5,000, it is a small claims proceeding. In a small claims proceeding you may offer 2 estimates to determine damages.

Q. 3. Are they obligated to pay for a rental vehicle while the vehicle is being repaired.

A. Probably not, but you can try.
