Legal Question in Civil Litigation in New York
Property Damage
I returned home from work to find the bottom section of our driveway sunken in, cracked etc... my neighbor advised me that a construction vehicle carrying a crane had backed into our driveway to turn around, caused the damage and drove off. Luckily, she wrote down the company name. I have called them and they agreed to have it repaired but want to patch it in. We just put the driveway in last year (new house) and do not want it patched, we want it the way it was before. They are giving us a hard time about that and they are in the process of getting estimates from differnt paving companies and are going to give us some options. Any advice?

Re: Property Damage
IF they are not willing to adequately compensate you, you may have to sue them for the value of the necessary work that is not covered by your homeowners insurance. You may want to consult with your insurance broker about these proceedings.
