Legal Question in Civil Litigation in New York

Rights to Remove an Internet Posting?

Person A was a webmaster of a local caterer's (Caterer XYZ) website several years ago. Caterer closed but did not take down the website. Person B was looking for a cater and found cater's website. Person B did some research on caterer and discovered that the address on the website was occupied by another company (Caterer XYZ moved a year before). Person B then posted on a caterer review website ''Caterer XYZ or Person A was not at the address on their website. There is a different company. This was suspect to me so I reported them to the county health department''. This review nows comes up number #1 in a google search on Person A's name. Person A believes this may negatively effect their livelhood and social life. Does Person A have any legal rights to get web posting removed?

Re: Rights to Remove an Internet Posting?

Yes you can try to have it taken down. Explain to the webmaster that it is a liabling statement and that he has 20 days to remove it or you will sue him.

Then do it.

Good luck
