Legal Question in Civil Litigation in New York

Signed Debt Agreement

I dated someone for 5 years, prior to our breakup he obtained a loan from a bank and gave me the money. My father passed and the bulk of the money went for funeral expenses, etc. We broke up 1 month after my dad's death and he (the ex) insisted on me signing a paper (which I drafted) stating the money was a loan and I would repay. A year later, I stopped making payments to him in June, because I honestly do not have the money anymore. He hired an attorney to ''motivate'' me to pay. How much validity does this Agreement between the two of have? If I had the money I would pay, but right now its impossible. If this goes to court or if he seeks other legal remedies, how much of a case does he have against me?

Please help

Re: Signed Debt Agreement

Since I do not know the exact language in the note, I cannot tell you if it is valid.

However, if the note simply stated, "I owe [name] the sum of $________." That would be a valid note.

Mike.
