Small Claims

I understand that the limit in NYC small claims court is $5,000.00. Is that exclusive of attorney's fees and costs? If the amount due is $4,880.00 & a contract provides for 25% attorney's fees, could that be filed in small claims? Thanks for your help!

The jurisdictional limit for small claims in NYC is actually $3000 and that is the value of the claim. Fees and costs not included. Claims for up to $25,000 can be filed in NYC Civil Courts. More than that must be filed in State Supreme Court.
