Legal Question in Civil Litigation in New York
Snow on my Property
I own a two family house located in Upstate Ny and have a neighbor who has a company come and do her snow removal via a riding snowblower. The men are blowing the snow up against my cellar windows and repeatedly i have asked them to clear the windows or dont put the snow there. I have even contacted the neighbor and she doesnt seem to care, you see she is the type that as long as its not on her property it isnt a problem. How do i get them to stop doing this?? Is it legal for her to have the snow blown on my property?? The home owner before me let her do anything she wanted and now she expects me to do the same. PLEASE HELP!!!!

Re: Snow on my Property
You should first start with a letter (by certified mail) to the snow blowing company placing the company on notice that it should not blow snow against the cellar windows.
If the company ignores the letter and blows snow against the window, you should take pictures, retain another company to remove the snow, and commence a small claims actoin against the snow blowing company for the amount paid to remove the snow from the cellar windows.
