My son in law father passed away left him his 401k can he draw from it now? This is in new York state

He can withdraw right away with penalty if not retirement age. Otherwise, he can withdraw according to age, minimum distributions, when he reaches retirement age. I would remove the money and transfer directly to familiar IRA administrators like FIDELITY.
