Statute of Limitations for defamation in New York is one year; however when does the time begin? While preparing to file a lawsuit for conversion and intentional infliction of emotional distress, plaintiff, in gathering evidence, discovered in police reports that defendant knowingly made false statements concerning the plaintiff and therefore included defamation in her lawsuit. Defendant is seeking dismissal of defamation issue on the grounds of the one year limitation as provided in CPLR.

In NYS, the statute of limitations for intentional acts, which includes defamation, run for the date the publication/event occurred.
