Statutory Rape

If an 18 year old girl has sex with a 16 year old boy, is that statutory rape? If the boy is 18 and the girl is 16 that is statutory rape, correct?

Is this throughout the USA? Or is it a state by state issue. I'm from NY and SC

In the age category you are using, the answer is no in both cases. . . and it is a state by state law. In NY, if the difference in age is four years, then the older person (male or female) is guilty of statutory rape.
