Legal Question in Civil Litigation in New York

Can I sue for my used auto purchase?

I purchased a used vehicle for approx. 10K, off of a used car lot. The salesman, at the last minute while I was making the purchase, pulled some sneaky stuff between him and the previous owner of the vehicle in an attempt to keep the sale out of his business records- however, we *did* buy the vehicle right off of the lot...From the very moment we pulled the vehicle off of the lot, it had major problems. So far, the repair bills are up to $1300 dollars, and the vehicle still does not run. We are sure that the used car company, as well as the previous owner- were fully aware that the vehicle had these problems, although the salesman informed us that the vehicle was in perfect running condition, right up to the time we paid for it- he hasn't returned a single phone call to us ever since...

Can we sue the used car company and/or the previous owner for the repair bills? The vehicle is inoperable without the repairs, and we informed both the salesman and the previous owner immediately, on the day of the sale, about the problems- both have offered no help, and the previous owner threatened physical violence if we pursued the issue...

Re: Can I sue for my used auto purchase?

This is a difficult situation. Yes, you have a good lawsuit. The 'Lemon Laws' specifically cover this situation. You have an excellant case and the proper court is either Small Claims or, better, Civil Court.
