Legal Question in Civil Litigation in New York

Being sued in small claims court for property - suffolk county, NY

A friend of my daughter had posted a question & referred me to this site.My daughter is being sued in small claims court(Suff. County)for property that was given to her by an ex-boyfriend.(specifically a tv/surround system). The person that is suing my daughter is the ex-girlfriend of the guy.My daughter was served & the claim states that she refused to return the items to the ex-girlfriend & is then being sued for $900. It was a bad breakup for my daughter & the ex.A full order of protection was issued with no third party contact. The father of the boy phoned my daughter & asked for the property & ultimately the boy was arrested for violating the order of protection. He did plead guilty to the charge & has not contacted my daughter anymore. The problem is that this ex-girlfriend then called & claimed that the property was hers. We would not give her the property even though she claimed she had receipts because the father of the boy said it was his & this boy owes my daughter thousands of dollars & has put her literally in finanancial ruin.I was told by a friend that my daughter cannot be sued for this property. The court date is on Dec. 1.Is there anything to stop this proceeding? What do we do, or what can we do?
