Legal Question in Health Care Law in New York
Can an Internet Marketing firm sell patient referrals (leads) to doctors, namely plastic surgeons? Are there any laws on this? What are they specifically? Are the laws different per state or nationwide?
Essentially, can a marketing firm promote a website that says "We match consumers with board certified plastic surgeons, please fill out your information to be matched with surgeons near you," and then sell that information (name, phone number, procedure, etc) to the plastic surgeon(s) near the consumer?
I have heard that doctors cannot sell referrals to other doctors/specialists, and I can understand the ethics there, but this is completely different. I appreciate any insight. Thanks!
