Legal Question in Health Care Law in New York
Medical Bills
My aunt passed away in the hospital. The medical coverage was in her name. Her husband was covered by it also. She does not have an estate. Her children were beneficiaries of the small amount of money that was in her 401k. Her children were also left the house. Does her husband have any obligation to pay the medical bills from the hospital...the amount left after her medical insurance covers its portion?

The husband is not responsible to pay the wife's bills unless he signed as a guarantor of the bill.
The estate is responsible to pay the medical expenses.
The 401k may pass outside the estate.
The house may have been in joint names as husband and wife, and would pass automatically to the husband even with the will.
