Legal Question in Health Care Law in New York
medical waiver
My son who is 21 was treated at the ER for a laceration on the nose. His insurance is medicaid. The doctor is suing me for the remaining balance due after the medicaid payment.
The doctor states that I signed a medical waiver that would make me responsible for payment. I do not recall signing this waiver. I went to court on this issue and the court was in favor of me. The doctor now has a trial de novo set and my trial date is set for this month.
Can I be held liable for this bill when I did not sign the waiver. I made sure my son signed all the necessary documents in the ER due to the fact he is 21 and has his own insurance. But the doctor is stating that I signed this. The document is very vague with a signature that is hard to read. Please advise me

Unless you signed a guarantee for your son you are not liable. So if it isn't exactly spelled out that you are financially responsible for your son, you are not obligated to pay.
