Legal Question in Immigration Law in New York

I have an apartment under my name, and my husband don't want to apply to adjust my status because i have that apartment and he is afraid immigration find out about that and we could have any problem because they could think we don't live together...is there any way they could find out i have that apartment under my name? we have a 1 year old baby together

If you live together in a bona fide marriage you shouldn't have any problems, even if you rent another apartment. If you are not in fact living together that is another matter entirely.
