Legal Question in Immigration Law in New York
Asked to file waiver based on misrepresentation at US embassy in Santo Domingo, chances?
I, USC, petitioned my husband of 2 years and was asked to file a waiver based on misrepresentation.
He was previously petitioned on a k1 that was revoked, got married to the petitioner, couple of years later divorced.
Aggravating factors: previous revoked petition, we speak the same language
Mitigating factors: previous relationship was in good faith, 3 year relationship with me
Hardship: back problems since 2009, multiple ongoing dental treatments since 2006 (lack of time and money), no family in his country, jr tax accountant, prone to glaucoma need constant checkup and tests
