You can file right away. The actual procedure varies depending on where your wife is located. Various petition and applications forms are necessary. If you are not confused by the uscis.gov and travel.state.gov websites, and you navigate the process on your own, you wouldn't need counsel, but without speaking with you at least, I cannot have a feel for whether you are a good candidate to handle such a matter without representation. You can petition for your immigrant wife ASAP. You need to first determine if your wife is eligible to adjust status. There are certain scenarios, although very limited, that would make her ineligible under the current law. The list of documents and forms is quite extensive and depends on your particular situation. You will need some of the following: birth certificates, marriage certificate, and evidence of how your wife entered the U.S. You may also need divorce documents from prior marriages and other information that is relevant to your particular case. Regardless of your situation or how comfortable you feel regarding the process, I highly suggest working with an immigration attorney. You will save yourself a tremendous amount of aggravation, time and potentially added expense of not doing it properly the first time. Please feel free to contact me at [email protected] or 212-643-0985 for more info regarding the process. I would need more information regarding your particular case before I can comment on it properly.
However, as a US citizen you can petition for your wife whenever you wish. As for the documents you will need to provide to the US Immigration Service, when you get the application there is a page that will be included which will advise what to send with the application.
