Legal Question in Immigration Law in New York
US Citizen marrying an Ecuadorian
I am a female US Citizen wanting to marry an Ecudorian. We dated at 17, however, we were young, and restricted to marry then. We are now 33 years old & each of us have 2 kids from prior relationships. We still have love for each other and want to marry and live a life together in the US. What are the guidelines and process I need to follow?

Re: US Citizen marrying an Ecuadorian
If your friend is divorced, then you have two possibilities: you can either file for a fiance visa on his behalf, and then if he gets the visa, and enters USA, you will have 90 days to marry; or you can marry him in Ecuador and then file a petition for him as your husband, so that he can enter USA.

It depends on where your fiancee is.
If he's already in the U.S. and entered legally with a valid visa (even if he overstayed), he may be eligible to apply for a green card while remaining in the U.S.
If he's outside the U.S., you have the option of a K-1 fiancee visa or K-3 spouse visa.

If your fiance is in the US, and originally arrived legally (with inspection), then we can get him his green card very cheaply and easily. Feel free to contact me.
