Legal Question in Immigration Law in New York

Can I become a US Citizen

I have been a resident alien for 22 years. 8 years ago I had a DUI. I want to apply for US Citizenship. Will my criminal record prevent me from becoming a US Citizen?

Re: Can I become a US Citizen

Congratulations on your efforts to become a citizen. While the DUI is not an asset and must be disclosed to the INS, it will not by itself prevent you from becoming a citizen.

It will not, by itself, prevent you because of the age of the misdemeanor offense and because it does not bear on character the same way murder, burglary, and other crimes do.

Since it's outside the 5 year statutory period, probably. I would show evidence of rehabilitation, like AA or other things to show that it won't happen again and that other than that one blemish on your record, you lead a law-abiding life and are a person of good moral character.

Re: Can I become a US Citizen

since you have only one misdeamenor on your record and it was many years ago, you should be able to overcome any bars by proving that you are not likely to commit a crime in the future and that you just made a mistake! The evidence you submit is vital to this case.
