Legal Question in Immigration Law in New York

Coming back to usa

I am a green card holder and was charged with domestic battery. The case was dismissed by the judge on the day of trial so I have no conviction on my record.

I would like to leave the USA for vacations but fear I will have a problem coming back. Can I be denied entry even though I am not convicted. Should I carry the letter of court disposition with me at all times? any help is appreciated.. I cannot expunge my record immediatly as these things take time..

Re: Coming back to usa

Carrying the 'letter of disposition' is an excellant idea. However, this action is unlikely to even have been reported to the INS.

While it is true that criminal activity can undermine your 'status', the dismissal of the charges indicates that you have not engaged in criminal activity and should have no worries on this issue.

Enjoy your vacation.
