Legal Question in Immigration Law in New York

consequences of marrying without fiance visa

I used to have a student visa and I am currently in the states on the visa waiver. If my fiance and I get married without a fiance visa will we get in trouble and will i still be able to change my status without getting married through a fiance visa?

Re: consequences of marrying without fiance visa

Congratulations on your marriage.

It is OK to get married first and catch up your immigration status later as long as you are never 'out of status'.

Its always best to have a lawyer prepare your immigration documents.

Re: consequences of marrying without fiance visa

1. I used to have a student visa and I am currently in the states on the visa waiver. If my fiance and I get married without a fiance visa will we get in trouble? Probably no, but depends on additional facts and law specific to your circumstances.

2. and will i still be able to change my status without getting married through a fiance visa? Not sure what you are asking here. Can you return to your foreign residence and the re-enter on a fiancee visa? Probably yes, but depends upon additional facts and law specific to your circumstances.
