Legal Question in Immigration Law in New York
deportation
i have a friend who has been in this country for 10 years they have four kids in this country, who are us citizen. now this person was caught by imagration while traveling on vaction. what are the chances that they will deport her. she has never been in any trouble and does not have a criminal recod.

This is a difficult situation. The INS may deport her. However, she must makje the argument to the INS 'Hearing Examiner' that this will cause 'hardship' to her family. That is the only defense.
