Legal Question in Immigration Law in New York

Deportation

Hi how long those INS take to visit a prisoner that is facing deportation, my boyfriend is coming out in 5 months and INS has not visited him to know what he is planning to do meanning is he going to appeal his deportation? or just wait for his sentence to be completed and then get deported? because i still beleive that his case has to go to a INS judge to be signed for deportation. He thoesn't want to wait a long time in jail after he completed his sentence, how can we know more about this process and should he be the one to call INS to visit him in jail or just wait untill they visit him? Thank you...

Re: Deportation

I would need alot more information about the situation to properly answer your question. If there is an INS detainer on him, after he is done serving his time, he would go into immigration custody. It would depend whether he can get out on bond. If removal proceedings haven't already started (or finished) against him, that is likely to happen.

You should consult with an immigration attorney to better assess the options your boyfriend has.

Our office concentrates in criminal deportation defense. Should you wish to call or email, please do so and we would be happy to provide you with a consultation.
