Legal Question in Immigration Law in New York

I am in a very difficult position. I got married 2 months ago to american citizen. Before marriage I was in usa ilegally for about 2 years. We didnt sent application to ins for adjustment of my status because we were waiting for all kind of documnets. Last week my husband got arrested and he has a hearing in a month. But it is possible that he gets several years of prison. Should we send forms to ins, can I get divorce and stay in the country?

I am sorry for the challenge of prison that has come to your husband.
But the good part (the not-bad part) is that he is still an American citizen and you are still his wife. The Immigration issues have not changed.
It would be a good idea to see a lawyer to smooth the process for you.
