Divorce and Remarriage

I married a permanent resident with my expired b-2 visa and the marriage is failed just after 8 months. We married in New York and we live in New Jersey.

I would like to know whether I could go ahead and divorce him and marry again with good intentions to get my documents to work with or that will be a problem with my 2nd marriage. I married him not for anything ;cos he was well-off but now I am in a dilemma and I want to stay here too so what should I do

Im would also want to know if it is possible to marry in another stat without the divorce should he give me problems with the divorce.Please help 'cos I am so confused.

You need to obtain a divorce in order to remarry regardless of which state you reside in.

Depending on the circumstances of the first marriage and why it "failed", we may be able to file a waiver for you or help you avoid deportation.

This is an easy question. You must divorce the first man before you can marry another. In addition, just because the marriage failed and you become divorced does not mean you will be deported. There are many ways to avoid that.
