Legal Question in Immigration Law in New York
divorced and remarring a citizen
my boyfriend came in the country legally and he was married to a us citizen for 2 1/2 years he did not get his green card. he have a 4 years old american citizen son. he filed for divorce and it was granted in july 2007. i was married befored and i am an american citizen. can i apply for him if we get married? and is he out of status? how long does he have befor remarring.

First, you will not be able to file anything for him until you are married. That said, he should consult with an immigration attorney to discuss his full immigration history and to determine if he will be eligible for benefits once you are married.
