Legal Question in Immigration Law in New York

E2 visa transfer

I've been working with an E2 visa for a year and a half in the US. I would like to know if I'm eligible to work for another company in the US, weither it's with this visa , or by transfering it into an H1B.

Re: E2 visa transfer

Your current visa only entitles you to work in the capacity (and for the employer) set forth in the application filed with the Consulate in your home country.

You may be eligible to change status to H-1B, but right now there are issues with H-1B visa number availability (i.e., there will be no H-1B visas avaialble until October 1, 2008). It is possible that your employer is cap exempt.

My website has more information on the types of visas that are available.

Re: E2 visa transfer

you may apply for a different category if you are eligible. You can also extend your E-2 visa.
