Legal Question in Immigration Law in New York

extortion by illegal alen

A employer had an illegal alein working for them for 5 years. He payed

cash, now the employee is saying he was payed below minimum wage.

This is not true, it is now scheduled for a trial by Jury. Isn't the

employee guilty of extortion and perjury? What can be done about this?

The Employee is entitled if he was paid below minimum wage to report that to the labor department and if there are criminal laws broken to have that agency forward that info the the proper authorities for further investigation. As whether it is extorsion, NO is not, unless that info was used as a quid pro quo for some financial gain or favor. The best thing you can do is have solid legal representation on your side.
