Legal Question in Immigration Law in New York
Family petition through marriage
My husband petition for me back in may of 2008. we have our first interview in december of 2008. We were asked to come back for a stokes interview. we are preparing for the interview and now my husband left me. one week before my interview. I am afraid, he left cause I found out that he has not resolved his child support case. and he also got a warrent for suspended license. I am so scared about my interview. we are of good faith, but my husband is a bit immature when it comes to matters of the law. by the way he is 2 years younger than me. PLease any advice for my stokes interview please. thank you

More details are needed to evaluate your exactly your case - nature of your relationships, why exactly he left, your current status, etc.
There might a way to file without your husband, but you need to consult a lawyer.
You can contact our firm if the matter is not resolved.

In general, USCIS requires that your husband attend the Stokes interview with you in order approve your application. You should consult with an attorney to determine your options at this point to ensure that you do not jeopardize your application.

Did your husband say that he will not go with you to the interview?
Is he now planning on divorcing you?
