Legal Question in Immigration Law in New York
filing for us citizenship, but... have matters to ask!
Hi. Had conditional green card on 6/2001 and now got perm. green card on 5/2004.But was arrested on 5/2002 because of misdemeanor B(120.00,120.14,265.01,120.15,110-120,240.26). After one year pled guility & was sealed after conviction & was bargained to 240.16 misde. A and had 10d comm. svc, 1 yr probation & order of protection on 9/30/2003. Now can I apply for us citizen on 6/06 or have to wait till 5/09? Is it safe to apply even though I have arrest record and been charged for mis. A w/ 240.16? the green card interview went smooth becuz they didn't ask me about the arrest & charges. I am scared. I am married to us citizen for 6yrs & would be very happy if i can become a us citizen. Is my charge deportable? Thank you very much for your concerned advice & direct me to the right path.

Congratulations on your successful marriage and good life.
The fact that you haver not reported the misdemeanor A is a problem. The INS is slow and lacking in competance, but this is likely to surface sometime in the future and it will be a major problem
You can control the damage by reporting the Misdemeanor A yourself. If you do, there will be few consequences.
