Legal Question in Immigration Law in New York
Filing Taxes
My sister came here as a visitor and overstayed. She is now married to a US citizen, but during her stay she worked (self-employed) and filed tax returns. She is no longer working;her husband is going to sponsor her. Because she worked (although she was not authorized to do so), will this hinder her chances of becoming a permanent resident?

Re: Filing Taxes
Your sister can still become a lawful permanent resident (green card holder). Since she is already married to a US citizen, it might be a good idea for her to file for adjustment of status. While her adjustment of status is pending, your sister can get her employment authorization so she can work. Should you decide to retain an immigration attorney for this matter, I would be happy to help you. Best of luck!
