Legal Question in Immigration Law in New York

foreign workers

My brother has an application approved by the department of labor to work in the US, but now the imigration department sent him a letter saying the the employer does not pay enough taxes to employ somebody. What my brother should do?

Sounds like USCIS is questioning the employer's ability to pay -- this can be a complex issue to resolve especially for smaller companies. Contact the employer's immigration counsel or retain your own attorney to respond to the RFE letter or the I-140 petition on behalf of your brother is going to be denied.
