Legal Question in Immigration Law in New York
Hi! I am a green card holder, I got the card thru marrige, it is valid for 2 years and will expire in March 2010. However, I am divoricing my husband and I am moving back to Europe within a couple of weeks. I am not planning on moving back to the US and live here, but I will definitley want to travel back to visit my friends etc. My question is: Is it ok to let the green card expire? By doing that, will I have any problems if I decide to travel for vaccation back to the US? Or do I have to send any papers in to immigration?? Please let me know. Thank you

If you do not plan to keep your green card, we would suggest you to abandon it officially.

I would need more information regarding your particular case before I can comment on it properly.
However, I am sorry to hear about the failure of your marriage. All that I can say is that you should contact the immigration service and tell them of your circumstances so that there is a record of it on your file.
If you do not do that and you just leave when you try to return you will be stopped at the airport for your green card will have expired and immigration will want to know where you have been. So it's best to tell them up front and allow you the privilege of returning for a holiday when you wish.
