Legal Question in Immigration Law in New York
Green Card Revocation
My wife (a doctor) got green card on National Interest Waiver application in '97 to work for medically underserved area for 2 years. When application was sent, she did not even have a residency training position. The application was that she will work for that area after she compeltes residency. NIW was approved in '97, she got residency in '98 and green card in '99. She completed residency in 2001, and fellowship in 2003, but didn't work for that underserved area subsequently. She did work for some other medically underserved area (for less than 2 yrs) after fellowship. (Her fellowship and residency were also in areas that were underserved, though different from the one on which the NIW was approved ) She is now scheduled for citizenship interview. She has paid taxes for full time work since 98 and has no criminal record. She has a letter form the original employer stating he could not employ her subsequently due to his ill health & because there was fire in the clinic which closed the clinic for few months. Her Green card is permanent (10 years) it and states category as ''E26'' on green card. Will she have any problem with citizenship. Can they revoke greencard? Have there been any cases like this where there was problem?

Re: Green Card Revocation
She is 'in status' and will not have a problem. She should get approval for her new location at the earliest opportunity. Good luck.
