Legal Question in Immigration Law in New York

H1-B for photography denied PLEASE HELP

my h1B to work asA photographer was denied by the consulate in my home country. my attorney told me to reapply, the US again granted my petition, but it was denied again at the consulate. their reason was that my BA is in Liberal arts and not photography. i am currently here on visitor status trying to sort this out, (90 days - 30 remaining).

1- do i truly need the degree in photography to get this visa? i have 8+ years experience.

2- can i apply for the student visa to make up the courses that would turn my BA into the photography BA?

3- can i do this without leaving the USA or by leaving only forA short time?

4- is there any way my denials can be overturned?

the second denial is currently being appealed by my lawyer. my file is being reviewed by the consulate but this has been going on for 6 months.

5- is there any way to expedite this process or should i just give up on it? my job is not going to be around for much longer.

6- could i interview at another consulate other than the one in my home country? i have dual citizenship.
