Legal Question in Immigration Law in New York

H1b for 5 years exp., Non Bachelors certificate

Hello Sir,

I am from india & I have done a 3 years of engg. diploma and then I got

admission to Engg. Degree (bachelors), I completed all years but for

some family and financial reasons I could not clear all the papers and

thus do not have degree certificate.

Later I did a 6 months full time diploma in Advanced Computing from

India's one of the well known CDAC center, and started doing job as

Software Engg. Today I have 5 years of exp. in software development,

requirements analysis, design and system software.

A company from USA has offer for me to come and work in USA.

My question is am I eligible for H1b ?

Normally, you have to have a foreign degree that is equivalent to the U.S. bachelor's degree to qualify. It may be possible, though difficult, to prove that you have satisfied the curriculum requirements without producing the actual degree certificate (i.e., through course transcripts, etc.).

Occasionally, significant and relevant work experience may provide a substitute for a bachelor's degree. However this must be evaluated on a case-by-case basis. In any event, the typical entry requirements for the position must be at least a bachelor's degree in a particular field.
