Hi,

You can file an immigrant petition (also known as I-130 petition) for your husband. However, if your husband entered the U.S. without inspection, he cannot adjust status in the U.S. There is still a benefit in filing the I-130 as the priority date is established, and when and if the law changes (for example, if section 245(i) is extended) only adjustment of status application is required to be filed instead of the I-130.

You can call our law firm at 212-268-3580 during business hours if you have questions, or email [email protected]

If you are a U.S. Citizen, you can file for your husband. However, there are certain limitations (entry without inspection, criminal records, etc). More information is needed in order to determine if you husband can get his green card through you.

You can contact our firm if you need further advice.

Good luck!
