Legal Question in Immigration Law in New York

My wife entered this country iligaly in 1988 she was only 5 month old her mother applied for her paper's in 1999 she also included all her kids in the application but she did not receive her green card my wife is now 20 and we just got married june 2 2008. I was born and raised in the U.S is there any was i could request my wife to become legal ?

Based on the information that you provided, you should be able to file a green card for your spouse. There are special procedures though that you must follow in order for her to be able to receive her green card. Additionally, she will have to pay an increased fee because she entered illegally.

I recommend that you have an attorney help you with the application as this process can be complex because of your spouse's illegal entry.

You can file a petition for you wife and she can get a green card based on her marriage to a U.S. Citizen.
