Legal Question in Immigration Law in New York

I'm an immigrant, being abused by my American spouse

Hi,

I'm a Columbian immigrant in NY state, and I'm being physically abused by my husband, a US citizen. We've been married for three years, and he's claiming to have me listed as mentally ''deficient'' and have me removed from the country if I don't stay with him. I don't know what to do, and I don't know how to leave my marriage without possibly exposing myself to deportation. I'm a legal immigrant working in NY from Columbia, and I'd appreciate some help.

You do not state whether you are a green card holder or not. If you are in an abusive relationship, there may be immigration relief for you as an abused spouse. I recommend that you contact an attorney to discuss your options.

If you would like to discuss your case in greater detail, do not hesitate to contact my office directly.

You should not be a victim of spousal abuse just because you fear for your immigration status. The Immigration law has several provisions that might protect you, depending whether you have a green card already or not. You should contact an immigration attorney to explore your options. If you have further questions, you can contact our office.
