Legal Question in Immigration Law in New York

Immigration

I was granted conditional green card through marriage. My husband was very abusive, so I left the relationship. I have police reports, orders of protection, and even had to seek counselling from a psychiatrist and counselors. My husband filed for divorce which I signed, but it did not say that I left the marriage because of cruelty. I just wanted out because of the abuse. We have no children together, but I have 2 who were granted the same status as me. We had a lot of documents showing that we had a real marriage and things together. How hard will it be to remove the condition on my green card.

Re: Immigration

While normally you are required to file a joint petition with your spouse to remove the condition, there are exceptions, and your situation may qualify for such an exception. While I cannot say whether it will be "difficult" or "easy" to have the condition removed, as long as you can prove that the marriage was entered into in good faith and that your relationship continued after your conditional residency was granted, the CIS may favorably adjudicate your application to remove the condition.

As always, you should consult with an immigration attorney for a better understanding of your case. Should you wish to contact our office, we would be happy to help.

Good luck!
