Legal Question in Immigration Law in New York

I'm a American citizen and I was told my parents can be cosponcers because I didn't file taxes.. I have temperary residence in Poland. The warsaw embassey told me I have to have permanent or job permitt residence or job permit for 6 months before I could file. This isn't possible but we don't want to wait a year for this neither. She is Polish citizen. Im from NY..

You can apply for your wife. If you do not have enough income, you need a sposnor from USA.

Check if you must file a tax return

Unless specifically exempted, the worldwide incomes of US citizens and permanent residents are taxable under US income tax laws.

If you have incomes, even if earned outside the US, you should check whether you have to file a US income tax return. Filing does not necessarily mean that you will owe taxes. If your incomes are exempted from income taxes, you may end up with not owing any income taxes. However, you may still have a duty to file the return.

The first step in applying for an immigrant visa is for the U.S. citizen (petitioner) to file an immigrant visa petition;

As to affidavit of support, If the petitioner's income is not sufficient then an additional sponsor must be found who willing to assume financial responsibility for the visa applicant.
