how long do i need to wait before filing for a divorce

after obtaining a green card from my spouse

The answer depends upon whether you obtained a CONDITIONAL green card, or an UNCONDITIONAL green card. Typically, if you are married for less than 2 years when the green card is issued, you will be issued a two-year CONDITIONAL green card. If, however, you obtained a 10 year green card through marriage already, you can divorce at any time. I HIGHLY recommend that you consult with an attorney knowledgable in BOTH immigration and family law, such as those in our firm before making any moves to get a divorce. Wrong timing could result in your loss of your permanent resident status, and so a little money spent on a consultation is well worth the cost in a case like yours. Good luck!
